This Acceptable Use Policy ("AUP") forms part of the Terms of Service between YourCart Ltd ("YourCart", "we", "us") and the merchant ("you") subscribed to the YourCart platform. By signing up to YourCart, you agree to comply with this AUP at all times.
YourCart's core deliverable is a branded mobile app for your shop, published to the Apple App Store and Google Play. Both stores enforce content policies — Apple App Store Review Guideline 1.4 ("Physical Harm") and Google Play's "Restricted Content" / "Dangerous Products and Substances" policies — that prohibit publishing apps which sell or facilitate the sale of certain product categories.
If your business sells any of those categories, we cannot publish your branded app, and the YourCart service is therefore not deliverable to you. This is not a YourCart preference; it is a constraint imposed by the distribution channels we depend on.
This AUP exists to make those constraints explicit at the moment of sign-up, so that you do not enter the YourCart programme expecting a service we cannot deliver.
You agree not to use the YourCart service to sell, advertise, list, take orders for, or otherwise commercially facilitate any of the following:

These prohibitions apply regardless of legality in your jurisdiction or the customer's. They reflect the limitations of the App Store and payment-processor distribution chain that YourCart relies on, not a moral judgement on the products themselves.
Alcohol vendors are not currently permitted on YourCart. We may, in our sole discretion and subject to additional terms, accept alcohol vendors in future. Until and unless such terms are published and accepted by you, the prohibition is absolute. Nothing in this section creates any commitment to enable alcohol sales on the platform.
In addition to the restricted verticals above, you agree not to use the YourCart service to:

This list is illustrative only. We may, in our sole discretion, determine that a product, service, or business activity falls within a prohibited category, and our determination is binding on you.
You acknowledge and agree that your branded app will be subject to:
If your business activity, or any change to your product range, brings your app or your Stripe account into conflict with these external policies, we may suspend or terminate the YourCart service to you immediately and without prior notice. The exercise of this right is at our sole discretion.
You agree not to:
We operate rate-limiting and abuse-detection at the platform level. Suspected abuse may result in temporary throttling without notice.
If we receive lawful legal process (a court order, ICO information notice, police request under PACE, etc.) requiring us to disclose or preserve information about your account or your customers, we will:
We may, at our discretion and to the extent permitted by law, notify you of the request. We are under no obligation to notify you, and may decline to do so where notification could prejudice an investigation, our own legal position, or the safety of any person.
You agree to cooperate with us in the event of a Data Subject complaint to the ICO that requires our coordinated response.
Where we believe in good faith that a breach of this AUP has occurred or is imminent, or where we have concerns about the operation of your account, we may at our sole discretion:
We are not required to follow any sequence of remedies, are not required to provide a remediation opportunity prior to suspension or termination, and may apply any remedy in any order. The choice of remedy is at our sole discretion.
In addition to any termination right under section 8, we may terminate the Terms of Service and the YourCart service to you at any time, for any reason or no reason, on 30 days' written notice. On such termination, we will refund a pro-rata share of any pre-paid subscription fee for the unused period of the then-current billing cycle, less any deductions permitted under the Refund Policy. This right exists independently of any breach by you and is exercisable at our sole discretion. We are not required to give a reason, and the exercise of this right does not constitute an admission of fault or liability.
When this AUP is updated to a new version, we will notify active merchants by email. Material changes (additions to the restricted-vertical list, new prohibited categories) require re-acknowledgement before you can continue using the platform — you will see a one-time blocking modal in the vendor admin app on your next login asking you to read and accept the new version.
Non-material changes (typographical fixes, clarifications without expanded prohibitions) are deemed accepted by continued use after the notification email.
Until Phase A of the platform restricted-vertical work has shipped (the audit-table-backed sign-up acknowledgement that underpins this section technically), any use of the YourCart platform after the notification email is sent constitutes acceptance of the new version, including for material changes. Once Phase A has shipped, the blocking-modal mechanism above governs material changes from that point onward.
You will indemnify and hold harmless YourCart, its officers, employees, contractors, and agents from and against any third-party claim, loss, damage, fine, regulatory penalty, or legal cost (including reasonable legal fees) arising from or in connection with:
This indemnity survives termination of the Terms of Service.
We have no liability for any decision, action, or inaction of Apple, Google, Stripe, Microsoft, Mailgun, or any other third-party distribution, payment, hosting, infrastructure, or communication partner, including but not limited to the removal, suspension, refusal to publish, restriction, throttling, fee change, policy change, or termination of your branded mobile apps, your Stripe Connect account, your hosting environment, your email deliverability, or any other component of the YourCart service that depends on a third party. The exercise of any such third-party decision does not constitute a breach by us of the Terms of Service, and does not entitle you to a refund or service credit beyond what is set out in the Refund Policy. We will use commercially reasonable efforts to keep you informed where we are aware of material third-party action affecting your account, but we make no guarantee of advance notice or successful resolution.
This AUP is governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes arising from it.
In the event of conflict between this AUP and the Terms of Service, this AUP prevails on matters within its scope. The Terms of Service prevail on all other matters.
